SEC CONTACTS REGARDING Malcolm H. Philips Jr.
Over a period of years I provided the SEC with evidence regarding Malcolm H. Philips Jr. It began when an SEC Attorney in the Chicago office requested I provide him with my telephone number. He called immediately. After volumes of documents regarding Malcolm were provided to the Chicago SEC Offices, I learned another CDEX investor had been performing similar duties by providing the SEC Dallas/Ft Worth authorities with evidence regarding Malcolm. Subsequently, we were instructed to funnel all new evidence to the SEC's Los Angeles Regional Office, which we did. I've sent a recently received document (including electronic proof of source) to the authorities at each SEC office stating MALCOLM H. PHILIPS JR. threatened to bankrupt CDEX before ever allowing anyone else to gain control of this public company. Specifically, and I quote: "In several (recorded) meetings, Malcolm Philips alternately stated that he would step down for the good of the company or that he would let the company go bankrupt (he had chapter 7 in mind) before he would give up control. One early scenario he spoke of was that he would put the company in a file drawer before he would let it go to others. This was witnessed by the whole staff, many of whom also recorded the proceedings." end quote I will share that MALCOLM H. PHILIPS JR. told me directly on the last phone call we ever had that he was interested in taking CDEX private, and that "any CEO worth his salt would do the same." I will swear to this under oath and am willing/able to be deposed. With MALCOLM H. PHILIPS JR. now neck-deep as a creditor in the CDEX Chapter 11 proceedings forced by 3 individuals, I strongly urge any/all that have evidence regarding Malcolm's CDEX shares contact the authorities and provide what information you have to offer. Of special interest to many is anything related to Malcolm when he was with Winston & Strawn and their contract regarding Yucca Mountain was cancelled. Perhaps related to conflicts of interest. Interesting because Malcolm's old buddy, George Dials, may have been involved in that one. Yes Malcolm, it IS too late to unwind what you've set in motion.
